Basic principles
- The terms used in this privacy statement and defined in the General Data Protection Regulation (GDPR) have the meaning assigned to them in the GDPR Act.

Breek de Week Kids only shares your personal data with third parties with your consent, if this is necessary for the performance of the agreement, or to comply with any legal obligation. With parties that process your data on our behalf, we enter into a data processing agreement to ensure the same level of security and confidentiality of your data. Breek de Week Kids remains responsible for these processing activities. This is for the integrity and security of the data.
Personal data that we process
Below you will find an overview of the personal data, purposes, legal bases, and retention periods that we process per category. We also indicate for each category with whom your data is shared.
customer data
Personal data and purposes:
- Name and address details (first name, surname, address, postal code, city, country). For the execution of the agreement, invoicing, identification, maintaining the customer relationship and carrying out direct marketing activities.
- Contact and additional personal data (email address, telephone number, gender). To communicate with each other, to address you correctly, to provide support, to inform you of changes in products/services, and to carry out direct marketing activities.
- Payment details (bank account number, VAT number). To process your payment and for VAT reverse charge if your company is established outside the Netherlands.

Carrying out direct marketing activities (we send you offers for similar products or services or tips about the products or services you have purchased) falls under “legitimate interest” (click here for more information).
Retention period:
Until one month after the termination of the agreement at the latest (click here for more information).
We retain your invoices for the statutory retention period.

With us and a number of our sub-processors such as Leeuwendael Evenementen, 't Brabants Genot, MS Producties (Fuutlaan 12 5613 AB Eindhoven), Go4boost Management Support, and Eventix. They are recipients or processors of the personal data. We have concluded a data processing agreement with them.

For the Google Analytics cookies, this means that Breek de Week Kids i) has entered into a data processing agreement with Google, ii) masks the last octet of your IP address, iii) has disabled 'data sharing' so that Google cannot use the personal data obtained for its own purposes (Google can only use it for technical support), and iv) does not use other Google services in combination with the Google Analytics cookies unless otherwise indicated in the 'Marketing & tracking cookies' section. You can contact us via a web form, for example. Every web form has one clear purpose, and should a form contain an additional purpose (for example, subscribing to the newsletter), we will ask for additional permission for this. By completing the form, you give us permission to process the requested personal data. For this purpose, we primarily use name, address, and city details, a telephone number, and an email address.

Consent is given by filling out the form or ticking the box to give consent for an additional purpose (click here for more information). You can withdraw your consent by submitting this via the relevant web form or by sending an email to jonathan@breekdeweekkids.nl.
Retention period:
We retain the data until we are certain that you are satisfied with our response. If the contact leads to an assignment, we retain the data for up to one month after the termination of the agreement (click here for more information). Our web forms may specifically ask for permission to inform you about future activities. In this case, we retain the data until you indicate that you no longer wish to receive these mailings. We retain your invoices for the statutory retention period.

Special and/or sensitive personal data that we process
Our website and/or service does not intend to collect data about visitors under the age of 16, unless they have permission from a parent or guardian. However, we cannot verify whether a visitor is older than 16. We therefore advise parents to be involved in their children's online activities to prevent data from being collected about children without parental consent. If you are convinced that we have collected personal data about a minor without such consent, please contact us at jonathan@breekdeweekkids.nl, and we will delete this information.

Automated decision-making
Stichting Waalre Bruist does not make decisions based on automated processing regarding matters that could have (significant) consequences for individuals. This concerns decisions made by computer programs or systems, without the intervention of a human (for example, an employee of Breek de Week Kids).
View, modify, or delete data
You have the right to access, correct, or delete your personal data. In addition, you have the right to withdraw any consent for data processing or to object to the processing of your personal data by Breek de Week Kids, and you have the right to data portability. This means that you can submit a request to us to send the personal data we hold about you in a computer file to you or to another organization named by you.
You can send a request for access, correction, deletion, or transfer of your personal data, or a request for withdrawal of your consent or objection to the processing of your personal data to jonathan@breekdeweekkids.nl. To ensure that the request for access was made by you, we ask you to send a copy of your proof of identity along with the request. In this copy, black out your passport photo, MRZ (machine readable zone, the strip of numbers at the bottom of the passport), passport number, and Citizen Service Number (BSN). This is to protect your privacy.
We will respond to your request as soon as possible, but within four weeks. Breek de Week Kids would also like to point out that you have the option to file a complaint with the national supervisory authority, the Dutch Data Protection Authority. If you have a complaint about how we or our sub-processors handle your personal data, we ask that you first discuss this with us so that we can see if we can resolve or adjust this to your satisfaction. If we cannot reach that point, you can always file a complaint with the supervisory authority.
How we protect personal data
Breek de Week Kids takes the protection of your data seriously and takes appropriate measures to prevent misuse, loss, unauthorized access, unwanted disclosure, and unauthorized modification. If you feel that your data is not properly secured or if there are indications of misuse, please contact us at jonathan@breekdeweekkids.nl.
Both we and our suppliers (processors) will endeavor to take appropriate technical and organizational measures regarding the security of personal data. We do not guarantee that the security will be effective under all circumstances. We will endeavor to ensure that the security meets a level that is not unreasonable, taking into account the state of the art, the sensitivity of the Personal Data, and the costs associated with implementing the security.
